Terms of Service

The short version: HelpBob scans your website, fixes accessibility issues at the source, and keeps a tamper-evident audit trail. You own your content; we never sell your data. Plans renew until you cancel, with a 30-day money-back guarantee on your first term. This page is the full agreement between you and Luna And The Stars LLC — together with our Privacy Policy and Data Processing Agreement — and the plain-English notes in each section are summaries, not substitutes.

HelpBob is a product of Luna And The Stars LLC, a Delaware limited liability company. On this page, “HelpBob,” “we,” “us,” and “our” refer to Luna And The Stars LLC.

01Agreement to these terms

These Terms of Service (the “Terms”) form a binding agreement between you and Luna And The Stars LLC (a Delaware limited liability company), referred to here as “HelpBob,” “we,” “us,” or “our.” They govern your access to and use of our websites, scanning engine, remediation script, dashboard, APIs, and related services (together, the “Service”).

By creating an account, installing the HelpBob script, clicking “I agree,” or otherwise using the Service, you accept these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization. If you do not agree, do not use the Service.

These Terms incorporate, by reference, our Privacy Policy, our Data Processing Agreement (which governs our processing of personal data on your behalf), and the plan documentation for the plan you select. Order of precedence: if there is a conflict, the following order controls, from highest to lowest — (1) your plan documentation or order form; (2) the Data Processing Agreement, for matters of personal-data protection; (3) these Terms; (4) the Privacy Policy and other referenced policies.

The short versionThese Terms, plus the Privacy Policy and DPA, are the full agreement. The plain-English notes throughout are summaries to help you read it — they are not a substitute for the actual clauses.

02What HelpBob does

HelpBob continuously scans the pages you connect, identifies barriers measured against the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a baseline, while we continuously work toward WCAG 2.2 Level AA, and applies fixes at the source through a lightweight script and your dashboard. We show you what was changed, when, and why, and we keep a tamper-evident record of every remediation so you can demonstrate the work later.

Not legal adviceHelpBob is a software tool, not a law firm, and using it is not legal advice. We help you reach and document conformance, but no tool can guarantee that a specific accessibility law has been satisfied in your jurisdiction. For that, consult qualified counsel.

03Accounts & eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly at [email protected] if you suspect unauthorized access.

  • One organization per workspace; you may connect multiple domains under a single plan where your tier allows.
  • You must own, or have written permission to modify, every site you connect to the Service.
  • You may not share a single seat with people who are not part of your organization.
  • You are responsible for the accuracy of the account, billing, and contact information you provide.

Sanctions & export compliance. You represent that you are not located in, or a resident of, a country or region subject to comprehensive US sanctions, that you are not on any US, EU, or UK restricted-party or sanctions list, and that you will not use the Service in violation of applicable export-control or sanctions laws.

04Subscriptions, billing & refunds

Paid plans are billed in advance on a monthly or annual cycle. Prices are shown in your local currency where available (currently USD and EUR) and exclude taxes unless stated. We may change pricing for future billing periods with at least 30 days’ notice; changes never affect a period you have already paid for.

Automatic renewal — and how to cancelYour plan renews automatically at the end of each billing period at the then-current price, and your payment method is charged, unless you cancel before the renewal date. By subscribing, you authorize these recurring charges. You can cancel at any time from your dashboard in a few clicks — cancellation stops the next renewal, and your access continues through the end of the period you have already paid for. For annual plans, we send you a reminder before each renewal. Where the law requires it (for example, under US automatic-renewal laws), we obtain your affirmative consent to these renewal terms at checkout and provide the disclosures and cancellation methods those laws require.

Except where required by law or under the guarantee below, payments are non-refundable and we do not provide prorated refunds for partial periods.

30-day money-back guaranteeIf HelpBob isn’t right for you, email [email protected]within 30 days of your first payment and we’ll refund that charge in full. The guarantee applies once, to your first paid term.

Taxes (including VAT or sales tax) may apply based on your billing location, and you are responsible for them. If a charge fails, we may retry it and suspend the Service until it is resolved.

05Acceptable use

To keep the Service safe and reliable for everyone, you agree not to:

  • Use HelpBob to mislead users, customers, or regulators about a site’s actual accessibility.
  • Connect sites you do not own or are not authorized to modify.
  • Reverse-engineer, decompile, resell, sublicense, or create derivative works from the scanning engine or remediation script, except to the extent the law expressly permits.
  • Probe, scan, overload, or load-test our infrastructure except through documented APIs and within published limits.
  • Upload, transmit, or process content you do not have the rights to, or that is unlawful, infringing, or malicious.
  • Interfere with the integrity, security, or performance of the Service, or attempt to bypass usage limits or access controls.

We may investigate suspected violations and may suspend or limit access to protect the Service, our users, or third parties.

06Intellectual property

You keep all rights to your website, content, and data. We keep all rights to the HelpBob software, models, documentation, and brand. “HelpBob” and the HelpBob logo are trademarks of Luna And The Stars LLC; you may not use them without our prior written permission, except to truthfully refer to the Service.

You grant us a limited, worldwide, non-exclusive license to access, scan, and process your connected pages solely to provide, secure, and improve the Service. We may create and use aggregated, de-identified statistics that do not identify you or your visitors to improve our detection and remediation, consistent with our DPA. If you send us feedback, you grant us a perpetual, royalty-free license to use it without obligation to you.

07Third-party services

The Service relies on third-party providers (for example, hosting, content delivery, payment processing, and email delivery) and may link to or integrate with third-party products. The providers that process data on your behalf are listed at helpbob.ai/subprocessors. We are not responsible for third-party services, and your use of them is governed by their own terms. Payments are processed by our payment provider; by purchasing a plan you also agree to that provider’s terms.

08Changes to the Service

We are always improving HelpBob, so we may add, change, or discontinue features of the Service. If we make a material reduction to core functionality of a plan you are paying for, we will give you reasonable notice, and you may cancel and receive a prorated refund of any prepaid, unused fees for that plan. Features labeled beta, preview, or early access are provided “as is,” may change or be withdrawn, and are excluded from any commitments in these Terms.

09Disclaimers & limitation of liability

The Service is provided on an “as is” and “as available” basis, without any uptime or service-level commitment unless separately agreed in writing. To the maximum extent permitted by law, HelpBob disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Service will be uninterrupted, error-free, or that it will achieve or maintain any particular level of legal compliance.

To the maximum extent permitted by law, HelpBob and Luna And The Stars LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

Carve-outs from the capThe limitations above do notapply to: (a) your indemnification obligations under Section 11; (b) your obligation to pay fees; (c) either party’s breach of its confidentiality obligations; (d) infringement or misappropriation of the other party’s intellectual property; or (e) liability that cannot be limited or excluded under applicable law (such as for gross negligence, willful misconduct, or fraud).

Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10Indemnification

You agree to indemnify and hold harmless Luna And The Stars LLC and its officers, employees, and agents from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your content, your use of the Service in breach of these Terms, or your violation of any law or the rights of a third party.

11Customer reference

We may identify you as a HelpBob customer and use your name and logo in our marketing and on our website, in a way that does not imply your endorsement beyond your use of the Service. You can opt out at any time by emailing [email protected], and we will stop using your name and logo going forward.

12Term, suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service; where practical, we will give you notice and an opportunity to cure. On termination, your remediation script stops serving fixes; we handle your data, including your audit trail, as described in our Privacy Policy and DPA. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, indemnification, and the general terms below) will survive.

13Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information. Nothing in these Terms removes any mandatory consumer-protection rights you have under the laws of your country of residence.

14Changes to these terms

We may update these Terms as the Service evolves. For material changes we will give at least 30 days’ notice by email or in-product before they take effect. The “Last updated” date at the top of this page always reflects the current version. Continuing to use the Service after changes take effect means you accept the revised Terms; if you do not agree, stop using the Service before the effective date.

15General

  • Assignment.You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. These Terms bind the parties’ permitted successors and assigns.
  • Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, outages, or government actions.
  • Notices. We give notices by email to your account address or by posting in the Service; you give notices to [email protected]. Notice is effective when sent.
  • Independent contractors. The parties are independent contractors; these Terms create no partnership, agency, or employment relationship.
  • Entire agreement. These Terms, with the Privacy Policy, DPA, and your plan documentation, are the entire agreement between us about the Service and supersede prior agreements on that subject.
  • Severability & waiver. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
